Public offer (terms of service)

Sole proprietor Бучнева Татьяна Игоревна (INN 695010283150, OGRNIP 321695200033167), hereinafter the «Contractor», offers any legally capable individual, individual entrepreneur or legal entity, hereinafter the «User», to conclude a service agreement on the terms of this offer (Art. 435, 437 of the Civil Code of the Russian Federation).

1. Terms

• Service — the EasyMag web service at https://easymag.ru and the Telegram bot @easymag_bot, which allow creating songs and music, song lyrics and poems, images with neural networks, as well as processing audio recordings (separating vocals from music).
• Coins — internal units of account of the Service that the User buys in packs and spends on Generations. Coins are not money and cannot be exchanged for money, except for refunds under section 6.
• Generation — a single creation or processing of a Result by the Service according to the User's parameters. The cost of Generations in Coins:
  • a song — 2 coins, as a rule two versions of the track;
  • an image («AI photo») — 1 coin, in 4K resolution — 2 coins;
  • separating vocals from music («Remove vocals») or splitting into stems (vocals, drums, bass, other) — 2 coins per audio recording;
  • a video cover (a video from a song and a picture) — 1 coin;
  • a karaoke video (a video with the song lyrics) — 1 coins;
  • «Singing photo» (the person in a photo performs a fragment of a song, up to 30 seconds) — 8 coins for each started 15 seconds;
  • trimming a song — free;
  • poems and song lyrics in the «Create poems» section — free, with a daily limit on the number.
  The current cost is shown in the Service before a Generation is started.
• Result — audio files, lyrics, poems, images and covers created or processed by the Service at the User's request.
• User Materials — texts, photos, images and audio recordings that the User uploads or enters into the Service.
• Demo — a free trial song Generation without registration: the Result can be listened to on the Website and downloaded after registration.

2. Subject of the agreement

The Contractor provides the User with access to the functionality of the Service for creating Results, and the User pays for the services by buying packs of Coins. The services are provided remotely via the Internet.

3. Acceptance of the offer

Acceptance of the offer is registration in the Service (signing in with a code from an email or via Telegram), payment for a pack of Coins, as well as starting a Demo or free features without registration. From the moment of acceptance the agreement is deemed concluded. To get acquainted with the Service, a new user is given a free Demo generation: two songs, of which the first 60 seconds are available for listening, without the right to download. After the first payment for a pack of Coins (or activation of a gift certificate) these songs become fully available at no extra charge. The Contractor may change the terms of trial access, including the number of Demo generations and the length of the fragment.

4. Prices and payment

Current packs of Coins (prices in rubles, VAT is not charged):

• «Starter» — 20 coins for 490 ₽
• «Creative» — 50 coins for 990 ₽
• «Advanced» — 120 coins for 1 990 ₽
• «Maximum» — 280 coins for 3 990 ₽

The trial packs «Trial» — 2 coins for 99 ₽ — and «Starter» — 6 coins for 199 ₽ — are for a User who has made a demo song and has not made any payments yet. They cannot be combined with discounts and are not sold as gift certificates; after the first payment they are no longer available.

Current prices are always published on the «Pricing» page. Payment is made by bank card, via SBP (the Faster Payments System) and by other methods available in the payment service of Robokassa LLC. The Contractor does not receive or store bank card data. Coins are credited to the balance automatically after the payment is confirmed. A cash receipt is sent to the User's email in accordance with Federal Law No. 54-FZ. There are no subscriptions or automatic charges.

5. Provision of services

1. Coins are debited at the moment a Generation is started.
2. If a Generation ends with an error through the fault of the Service or the neural network provider, the debited Coins are automatically returned to the balance.
3. The Generation service is deemed properly rendered from the moment the Result appears in the «My tracks» section. The Result is created by a neural network: its artistic qualities, conformity to subjective expectations and accuracy of pronunciation are not guaranteed. For another version the User may start a new Generation.
4. Coins do not expire while the Service is operating. Results are stored in the personal account, and the User can download them at any time. Images on the Website are shown in a lightweight form; the «Download» button gives the original.
5. The Contractor may delete Demo Results not linked to an account after 30 days. The number of Demos and free Generations is limited (including by device and IP address); in case of abuse the Contractor may refuse free access.
6. The Contractor may carry out maintenance, during which the Service may be temporarily unavailable.
7. The User may buy a pack of Coins as a gift certificate: the Coins are not credited to the buyer's balance; instead a code (link) is issued, with which another registered user credits them to their balance once. The certificate has no expiry date. A refund for a non-activated certificate is possible to the buyer under the rules of section 6.

6. Refunds

1. The User may withdraw from the agreement and get a refund for unused Coins. The refund amount is calculated in proportion to the number of unspent Coins from the paid pack. Welcome (free) Coins are not refundable.
2. Coins spent on completed Generations are not refundable: the service for them has been rendered (Art. 32 of the Law «On Consumer Rights Protection», Art. 782 of the Civil Code of the Russian Federation).
3. For a refund, write to the Contractor in the Telegram support bot @easymag_support_bot or send a written application to: 170100, Тверская обл., г. Тверь, пл. Славы, д. 1, кв. 38. State the account email, the date and amount of the payment. The application is considered within 10 business days; the money is returned by the same method that was used for payment. The crediting time depends on the bank.
4. If Coins were paid for but not credited, contact the Contractor in the same way — the Contractor will credit the Coins or return the money.

7. Rights to the Result and restrictions

1. The User may use the Results, including for commercial purposes (product cards, advertising, social media), within the limits permitted by the legislation of the Russian Federation and the terms of the neural network providers used by the Service.
2. The neural network creates the Result automatically, so the Contractor does not guarantee its uniqueness: similar Results may be obtained by other users.
3. By uploading User Materials, the User guarantees that they hold the necessary rights to them, and for photos depicting people — those people's consent (Art. 152.1 of the Civil Code of the Russian Federation), and that the use of the Materials does not violate the rights of third parties. The User grants the Contractor a royalty-free non-exclusive right to use the Materials solely for providing the services: storage, processing and transfer to neural network providers to create the Result.
4. Separating vocals from audio recordings whose rights belong to third parties is allowed only for personal use (for example, home karaoke). Distribution, publication and commercial use of such Results without the permission of the right holder are prohibited; the User is responsible for this.
5. «Charts»: when a song is created, the «Publish in the charts» option is on by default. While it is on, the finished song (the first variant; a demo song — once it is paid for) is published in the public «Charts» section with its title, lyrics and the author name the User gave or the one from the messenger (the e-mail address is never published). The option can be turned off before creating the song, and the song can be taken off the «Charts» at any time in «My songs in the charts».
6. It is prohibited to create images and songs that impersonate real people or mislead about their actions and statements, as well as product images that do not match the real product — when publishing on marketplaces and in advertising, the User independently complies with the rules of the platforms and the advertising legislation.
7. It is prohibited to use the Service to create materials that violate the legislation of the Russian Federation: extremist, pornographic, offensive materials, or materials infringing copyright, the honour and dignity of third parties. The Contractor may reject such a Generation or block the account.

8. Liability

The Service is provided «as is». The Contractor is not liable for losses related to the use of the Results, nor for interruptions caused by the actions of third parties (hosting, neural network providers, payment systems). The Contractor's total liability is limited to the amount paid by the User for the last pack of Coins. To create Results the Service uses third-party neural network providers, including those located outside the Russian Federation; their availability and terms may change, and the Contractor may replace providers without notice while keeping the functionality of the Service.

9. Personal data

The Contractor processes the User's personal data in accordance with the Privacy policy, which is an integral part of the offer.

By registering in the Service, the User consents to receiving advertising and informational messages from the Contractor (discounts, promotions, news about the Service's features) at the email address and in the messengers (Telegram, MAX) specified at registration. The User may opt out of such messages at any time: with the «Unsubscribe» link in an email, the «Don't send promotions» button in a messenger or the «Receive discounts and news» switch in the «Account linking» section; after opting out, advertising messages are not sent. Service notifications related to the provision of services are sent regardless of such consent.

10. Other terms

The Contractor may change the offer and prices by publishing a new edition on the Website. The changes do not apply to Coins already paid for. Disputes are resolved through negotiations, the claim period is 10 business days, and then in court at the location of the Contractor, taking into account the consumer's rights under Art. 17 of the Law «On Consumer Rights Protection».
